Eligibility:
1.The applicant(s) who are selected to be a part of the FX Networks "American Horror Story House Calls" (the "Scare"), to be unexpectedly scared must be available to participate in a scare in their hometown between August 10, 2011 and September 30, 2011. Additional days at the discretion of FX may be required for selected applicant to participate in taping and promotional activities.
2.All applicants must be 18 years of age or older at the time of application.
3.All applicants must be a legal resident of, and physically located within, the 50 United States or Washington D.C. at the time of application.
4.All applicants must be in excellent physical and mental health.
5.Employees of FX Networks, LLC ("FX" or "Sponsor"), GMR Marketing LLC, ("GMR"), or any of their respective parent companies, subsidiaries, affiliates, partnerships, advertising, promotions or fulfillment agencies, distributors, retailers, sales representatives or agencies of any of them (individually and collectively, "Entities"), or any of their respective any members of the households or immediate families of such persons are not eligible to apply or be selected.
6.Appearances in the Program shall not constitute a performance and will not be entitled to any compensation for such appearance, nor to any guild or union payments for the use or reuse of such appearance.
Application Requirements:
7.To apply, go to http://www.americanhorrorstoryhousecall.com and submit a Participant Application between 8:00 P.M. Eastern Time ("ET") on August 5, 2011 and 11:59 P.M. ET on September 30, 2011 ("House Calls Period").
8.Applicant must first carefully read, review and complete all of the required fields of the Participant Application including applicant’s first name, last name, complete home address (no P.O. Boxes), daytime phone, evening phone, e-mail address, fully complete all application questions, provide required relative and friend contact information, check the box acknowledging your age and that you have had the opportunity to review the Terms and Conditions, and click the box to read and click agree to sign the Assignment of Rights, Publicity Release, and Liability Release documents.
9.Incomplete applications that do not meet the requirements herein, will not be accepted.
Selection:
10.The potential participant’s relative and/or friend will be notified by phone/express mail at a time determined solely by FX during the House Calls Period to the phone number/address listed on the application submitted. The participant’s relative and/or friend must respond within 48 hours of the first notification or an alternate participant may be selected.
11.The applicant selected as the potential participant is subject to verification, including without limitation, verification of eligibility, compliance with these Terms and Conditions and completion of required assignment release forms (described below) agreed to at time of entry.
12.Applicant will be required to execute an Assignment of Rights, Liability Release and where lawful, a Publicity Release as determined by FX during the application process. Participant’s relative and/or friend will also be required to execute a Non-Disclosure Agreement, Assignment of Rights, Liability Release and where lawful, a Publicity Release as determined by FX and will need to respond within five (5) business days of notification for the participant to still be considered. If relative and/or friend of the participant fails to respond to the notification within 48 hours, if relative and/or friend fails to return all required documentation within five (5) business days, if attempted notification is returned as undeliverable, if any such person cannot be verified, or if the applicant is otherwise unable to participate in all aspects of the "scare" and all promotional activities in relation thereto, the applicant will be disqualified and an alternate participant may be selected provided sufficient time remains, in FX’s sole discretion.
13.Each applicant acknowledges, understands and agrees that if chosen as a participant, participant may be audio and/or videotaped during time as a participant of FX Networks House Calls "Scare" by means of both open and hidden cameras, whether or not participant is aware that participant is being videotaped and/or recorded (collectively "Recordings"), and that such Recordings may be disseminated on television, the Internet, radio, and any and all media now known or hereafter devised, in any manner throughout the Universe in perpetuity.
14.Each applicant understands that if selected as a participant, the activities required to participate with the FX production are inherently dangerous and may expose participant to risk of serious injury, illness, and/or property damage.
15.This Promotion is subject to all applicable federal, state, and local laws. By entering the Promotion, each entrant hereby: (a) agrees that the Entities will have no liability whatsoever for, and shall be held harmless by participants against any liability for any injuries, losses or damages of any kind to person(s), including emotional injury, illness, personal injury and/or death, or property damage resulting in whole or in part, directly or indirectly, from acceptance of or participation in this Promotion or any Promotion-related activity, including preparation for and production of the scare, and for any claims based on publicity rights, defamation or invasion of privacy, or for any typographical or other error in the printing, offering or announcement of the promotion; (b) releases the Entities from all liability, claims, action, or proceedings relating to this Promotion and from injuries or damages arising in connection with or relating to participation in this Promotion or preparation and/or production of the scare; and (c) waives any right to claim ambiguity in the Promotion or these Terms and Conditions. This Promotion may not be used for any form of gambling.
16.Applicant’s acceptance to be named the participant constitutes the grant of an unconditional right to use participant’s name, address (city and state only), voice, likeness, biographical and prizing information and/or statements about the promotion for any publicity, advertising and promotional purposes without additional compensation, except where prohibited by law, and hereby release the Entities from any liability with respect thereto.
Use of Data:
17.All applications may be shared by and between the Entities and each of the Entities will use such information in accordance with their respective independent privacy policies. Any communication or information transmitted to FX and/or the Website by electronic mail or otherwise is and will be treated as non-confidential. Please review FX’s privacy policies at. Application Data will only be shared and used by the Entities in connection with the fulfillment of the promotion, and in accordance with FX’s privacy policies. By participating, applicants hereby agree to FX’s collection and usage of their personal information and acknowledge that they have read and accepted FX’s privacy policy.
18.FX reserves the right, at its sole discretion, to disqualify applicants who do not comply with these Terms and Conditions, or attempt to interfere with this Casting in any way. ANY ATTEMPT BY AN APPLICANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CASTING MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, FX RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. FX reserves the right to change the terms of the application process at any time. FX also reserves the right not to select participants and to not produce any Advertising or other materials in connection with the House Calls if there are no qualified applications.
